This is a translation. If it differs from the Japanese version, the Japanese version prevails.

These Terms of Service (the "Terms") set out the conditions for using the messaging app "Orto" (the "App") provided by PeRRii (the "Operator"). Anyone who uses the App (a "User") agrees to these Terms before using the App.

Article 1 (Scope)

These Terms apply to all relationships between Users and the Operator relating to the use of the App.

Article 2 (The App)

  1. The App is a messaging app that lets you switch between multiple accounts (profiles) on a single device.
  2. Users can use the App after verifying their phone number. Each phone number has one authentication identity (user).
  3. Each User can create up to 2 accounts.

Article 3 (Registration and accounts)

  1. Users create an account by verifying their own phone number by SMS.
  2. Users are responsible for managing their own accounts and passcodes. The Operator is not liable for damage caused by use by a third party, unless the Operator acted intentionally or with gross negligence.
  3. An account ID cannot be changed after it is created. The ID of a deleted account cannot be reused.
  4. Users must not verify using another person's phone number.

Article 4 (Prohibited conduct)

When using the App, Users must not:

  1. Violate laws or public order and morals
  2. Defame, threaten, harass, or discriminate against other Users or third parties
  3. Impersonate others or register false information
  4. Collect or publish other Users' personal information without their consent
  5. Send or register obscene or violent messages or images, or messages or images that make others uncomfortable
  6. Send large volumes of spam, solicitations, or other messages the recipient does not want
  7. Place an excessive load on, or gain unauthorized access to, the App's servers or network
  8. Reverse engineer or modify the App, or interfere with its operation
  9. Engage in any other conduct the Operator considers inappropriate

Article 5 (Content posted by Users)

  1. Rights to the messages Users send and the images and profile information they register belong to the Users.
  2. Users permit the Operator to store, process, and display this content to the extent necessary to provide the App's services.
  3. Users warrant that they hold the necessary rights to the content they send or register, and that it does not infringe the rights of third parties.

Article 6 (Blocking and reporting)

Users can use the block feature to refuse messages and friend requests from specific accounts.

Users can use the report feature to report to the Operator accounts or messages that violate, or may violate, these Terms. The Operator reviews reports and, where necessary, takes action under Article 7. The reported party is not notified that a report was made.

Article 7 (Restriction and suspension of use)

If a User violates these Terms, or if the Operator determines that there is a risk of violation, the Operator may restrict, suspend, or delete the User's account without prior notice. The Operator is not liable for any damage this causes the User.

Article 8 (Deleting an account)

  1. Users can delete their own accounts at any time from within the App.
  2. Deleting an account does not immediately erase data from the system. Other Users see the account as "Deleted account", and messages remain in other Users' chat history. Data is fully deleted when the User requests it through the contact described in the Privacy Policy.

Article 9 (Changes, interruption, and termination of the App)

The Operator may change the content of the App, or interrupt or end its provision, without prior notice to Users. The Operator is liable for any damage this causes Users only to the extent set out in Article 10, paragraph 4.

Article 10 (Disclaimer)

  1. The Operator does not warrant that the App is free of factual or legal defects (including those relating to safety, reliability, accuracy, fitness for a particular purpose, security flaws, errors or bugs, and infringement of rights).
  2. The App does not guarantee delivery of SMS messages or push notifications. They may not arrive depending on network conditions, carriers, device settings, and other factors.
  3. Disputes between Users, or between a User and a third party, are to be resolved between the parties, and the Operator is not responsible for them.
  4. The Operator is not liable for damage suffered by Users (including indirect damage and lost profits), unless the Operator acted intentionally or with gross negligence. However, if the contract between the Operator and a User under these Terms is a consumer contract as defined in Japan's Consumer Contract Act, the Operator is liable for damage caused to the User by the Operator's negligence (excluding gross negligence) within the scope of direct and ordinary damage.

Article 11 (Handling of personal information)

The Operator handles Users' personal information in accordance with the separate Privacy Policy.

Article 12 (Changes to the Terms)

The Operator may change these Terms without notice to Users when it considers it necessary. The revised Terms take effect when they are posted in the App or on the Operator's website.

Article 13 (Governing law)

These Terms are governed by and interpreted under the laws of Japan.
